Plaintiff agrees to dismiss our client when facing a court hearing and an award of costs related to a Motion to Dismiss for Lack of Subject Matter Jurisdiction

On behalf of our governmental entity client, we filed a Motion to Dismiss for Lack of Subject Matter Jurisdiction based upon sovereign immunity (whether (1) the subject accident occurred on a "public sidewalk" as defined by the Colorado Governmental Immunity Act (CGIA); (2) whether carousel rides constituted a "public facility" as defined by the CGIA; and (3) whether covered electrical cords constituted a "dangerous condition" as defined by the CGIA). After the Motion was at issue, the Court requested a hearing on this Motion. Faced with a hearing and the potential of an award of costs against his client, Plaintiff’s counsel agreed to dismiss the claims against our governmental entity client.
